TRADEMARK LAW AND PRACTICE IN NEPAL
Priority is not available from a convention Application or for that matter any foreign Application. Multiple Class Applications cannot be filed in Nepal. Nepal allows Service Marks. The documents required for filing a new Trademark Application in Nepal are:
| a). | A Power of Attorney signed by the Applicant sealed and attested by two, witnesses. |
| b). | An Application form executed as above. |
| c). | A certified copy of the home or foreign registration certificate along with its authenticated translation in English by a Notary Public. |
| d). | Minimum 10 prints of the mark. (Not needed for word mark). |
| e). | The list of goods and the class is pertaining thereh; |
Remark: (Separate application and Power of Attorney have to be filed for per mark per class).
Registration of a Trademark in Nepal is based upon corresponding registration in Home Country or any other country in the World. A duly certified copy of the Home Registration Certificate is required to obtain registration in Nepal. In case the Home Registration Certificate is not in English language we require a duly verified and notarized English translation of the Home Registration Certificate for obtaining registration in Nepal.
